ORCA Terms of Service

These Terms of Service (“Terms”) constitute a binding agreement between you and ORCA AI, Inc. (“ORCA,” “we,” or “us”) governing your access to and use of the ORCA autonomous execution platform, website, and related applications.
1. The Service & Early Access
ORCA is an autonomous operational assistant designed to reason through requests, coordinate tools, and execute workflows. The Service is currently in active early-access deployment. Features, availability, and integrations may evolve during this phase.
2. Eligibility & Accounts
You must be at least 18 years of age to create an account. You are responsible for safeguarding your login credentials and for all operations initiated under your account.
3. Autonomy Levels & Authorized Actions
ORCA provides configurable tiers of autonomy per capability:
| Autonomy Tier | Operational Behavior |
|---|---|
| Suggest | Provides recommendations only. No actions are executed without you. |
| Prepare | Stages an action (e.g. draft email, cart, calendar invite) awaiting review. |
| Confirm | Executes an action only after your explicit, in-the-moment approval. |
| Auto Execute | Performs pre-approved, recurring, low-risk actions autonomously without per-action prompts. |
4. Connected Third-Party Services
When you link third-party accounts (e.g., Slack, Google, GitHub, Notion), your use remains subject to their respective terms and privacy policies. ORCA is not liable for upstream API outages, permission revocations, or third-party service modifications.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful activities, harassment, fraud, or deceptive impersonation.
- Execute autonomous actions on behalf of unauthorized third parties without permission.
- Attempt to reverse-engineer, exploit rate limits, or bypass safety guardrails.
- Ingest proprietary or private data without proper authorization.
6. Your Content & Personal Life Graph
Ownership:You retain complete ownership of all data, context, and prompts you provide (“Your Content”), including your Personal Life Graph.
License: You grant ORCA a limited, non-exclusive license strictly to process and store Your Content as necessary to execute workflows on your behalf. We do not sell your data or license it to third parties for advertising.
7. Disclaimers & Limitation of Liability
The service is provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, ORCA AI, Inc. and its affiliates shall not be liable for indirect, incidental, or consequential damages resulting from your use or autonomous actions taken within your configured permissions.
